These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and WitsType AI Inc., the operator of BirthHue (“we,” “us,” or “our”), governing your access to and use of the website and service available at birthhue.com (the “Service”).
By creating an account, clicking “Sign in with Google,” subscribing to a paid plan, or otherwise accessing the Service, you confirm that:
Having an account and generating a chart are two separate things.
Your account (18+). Your age is what you confirm when creating your account: BirthHue asks for your date of birth once, after you first sign in, and an account that is under 18 is not created. If we learn that an account belongs to someone under 18, we will delete it.
Charts you generate for others (any age). An adult account holder may enter the birth details of family, friends, a partner, or their own children to generate a chart. Doing so does not change anyone’s eligibility and does not create an account for that person. A child whose chart you generate never signs in and is never contacted by us. By entering another person’s details you confirm you have their permission (or, for a minor, that you are their parent or legal guardian), and you are responsible for that entry.
BirthHue is a digital platform that provides Vedic (sidereal) astrology readings, natal chart calculations, and related astrological content based on information you provide, including your birth date, time, and location.
The Service may include, depending on your subscription plan:
Account Creation
Access to the Service requires creating an account via Google OAuth. You agree to provide accurate, current, and complete information during the sign-in process and to keep your account information up to date.
Account Security
You are responsible for maintaining the security of your Google account credentials. Any activity occurring under your BirthHue account is your responsibility. Notify us immediately at support@birthhue.com if you suspect unauthorised access to your account.
Submitting Another Person’s Birth Data
If you use the compatibility/connections feature to submit a friend, partner, or family member’s name, birth date, time, or city, you represent and warrant that you have that person’s permission to share their information with us for that purpose. You are responsible for that representation; we rely on it and do not independently verify it.
If the person is a minor, including your own child, you may submit their details only as their parent or legal guardian. The 18+ requirement applies to holding an account, not to the people you generate charts for; the minor has no account and is not contacted. You can delete their chart at any time, or ask us to (see our Data Deletion Policy).

Subscription Plans
BirthHue offers both free and paid subscription tiers. Paid plans unlock additional features and content as described on the Service at the time of purchase. We reserve the right to modify plan features and pricing with reasonable notice to subscribers.
Paid plans are not available yet. The billing, renewal, cancellation and refund terms in this section take effect when they launch.
Payment Processing
All payments are processed by Stripe, a third-party payment processor. By subscribing to a paid plan, you authorise us (via Stripe) to charge your designated payment method for the applicable subscription fee. Your payment information is stored and managed securely by Stripe; BirthHue does not store your full card details.
Automatic Renewal
Paid subscriptions renew automatically at the end of each billing period (monthly or annually, as applicable) unless you cancel before the renewal date. The renewal charge will be the same as the prior billing period’s rate, unless we have notified you of a price change at least 14 days in advance.
Cancellation
You may cancel your subscription at any time. Upon cancellation:

Refunds
Refund requests are handled on a case-by-case basis. If you believe you have been charged in error, please contact us within 14 days of the charge at support@birthhue.com. Nothing in this section limits any rights you may have under applicable consumer protection laws in your jurisdiction. See our Refund Policy for the full details.
Taxes
Subscription prices shown are exclusive of any applicable taxes (such as VAT or GST) unless otherwise stated. You are responsible for any taxes applicable to your purchase.
Our Content
All content, software, design, text, graphics, algorithms, interpretive frameworks, and other materials that form part of the BirthHue Service (collectively, “Our Content”) are owned by or licensed to us and are protected by copyright, trademark, and other applicable intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit Our Content without our express prior written permission.
Your Data
You retain ownership of the personal data and content you provide to the Service (such as your birth data and journal entries). By using the Service, you grant us a limited, non-exclusive, royalty-free licence to use, store, and process your data solely to provide and improve the Service as described in our Privacy Policy.
Your Reports
Astrological reports and readings generated for you by the Service are provided for your personal, non-commercial use. You may save or print them for personal reference. You may not resell, redistribute, or sublicense these reports.
Feedback
If you submit suggestions, ideas, or feedback about the Service, you grant us a perpetual, irrevocable, royalty-free licence to use that feedback without any obligation to you.
The Service integrates with or may contain links to third-party services including Google OAuth and Stripe. These third parties have their own terms of service and privacy policies, which govern your use of their services. We are not responsible for the content, practices, or policies of any third-party service.
Any links to external websites are provided for your convenience only. Their inclusion does not imply our endorsement or approval.
We strive to keep the Service available at all times, but we do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to maintenance, updates, or factors outside our control.
We reserve the right to modify, suspend, or discontinue any feature or aspect of the Service at any time. If we make changes that materially affect your paid subscription, we will provide reasonable advance notice and a pro-rated refund if appropriate.

No Warranties
The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be error-free, uninterrupted, secure, or that astrological interpretations will be accurate, complete, or suitable for your purposes.
To the fullest extent permitted by applicable law, BirthHue and its operators, employees, and affiliates shall not be liable for:
In jurisdictions that do not allow the exclusion or limitation of certain damages, our liability is limited to the maximum extent permitted by law. In no event shall our total aggregate liability to you exceed the greater of (a) the amount you paid to us in the 12 months preceding the claim or (b) one hundred dollars (CAD $100).
Some jurisdictions provide statutory consumer rights that cannot be excluded or limited by contract. Nothing in these Terms is intended to limit those rights.
You agree to indemnify, defend, and hold harmless BirthHue and its operators from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of the Service, your violation of these Terms, or your infringement of any third-party rights.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there. Before starting any proceeding, both parties agree to try to resolve the dispute in good faith for 30 days. After that, the courts of Ontario (Toronto) have exclusive jurisdiction, except that nothing here limits any mandatory consumer rights you have under the law of your country of residence.
We may update these Terms of Service from time to time to reflect changes in the Service, applicable laws, or our practices. When we make material changes, we will:
Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, please stop using the Service and cancel any paid subscription before the effective date.
Entire Agreement: These Terms and our Privacy Policy are the entire agreement between you and BirthHue regarding the Service.
Severability: If any provision is found unenforceable, the rest remain in effect.
